Aiding and abetting serious crimes of international concern in
the OPTs: the role of EU and other European individuals

On the face of it, it is very difficult to bring Israeli individuals to account in the International Criminal Court for their activities in the OPTs simply because Israel is not a signatory to the Rome Statute of the ICC. However, the ICC stipulates that only one of the state parties involved in any conflict need be a signed-up 'state party' and that party could in theory be Palestine if it became a signed-up party to the ICC. Unfortunately, it is not clear yet whether the ICC will accept that Palestine qualifies as a state in order to pursue this option. In the meantime, there are alternative approaches to bringing Israel to account and that is by targeting those individuals of countries who are signed-up to the ICC. By bringing charges of 'aiding and abetting', in respect of Israel, against EU and European individuals, the ICC could make a profound impact on the Middle East conflict. In aiding and abetting in international criminal law, the beneficiary is usually designated as the Principal Offender (in this instance, Israel). Importantly, it is of no consequence in such circumstances whether the Principal Offender is a signed-up party to the Rome Statute of the ICC or not; this constraint applies only to those aiding and abetting.

Hence, this is an alternative approach to exerting international pressure on the State of Israel since a positive outcome at the ICC would clearly force the EU to dismantle those measures of support for Israel deemed as 'aiding and abetting'. This Proposal is a copy of our original Proposal sent to the Public Prosecutor at the ICC in September 2009. We invite comments from readers and would suggest that this alternative model of exerting leverage on Israel be taken up by as many organisations and individuals as possible.
